Terms & Conditions for GOcatalunya.com Advertisers

1. While we make every effort to reproduce all images and copy submitted to the site by advertisers as close to the original form as possible the site reserves the right to determine the final design and layout of all advertisements and to amend or edit any content within advertisements and cannot be held responsible for any change or loss of quality to images of any form submitted to the site.

2. The site accepts no legal responsibility for the accuracy of advertisements or any breaches or alleged breaches of contract on an advertiser's part and the advertiser indemnifies the site against all costs, expenses or losses that may arise from any claim relating to the content of an advertisement.

3. We make every effort to safeguard any images and copy submitted by advertisers and will return such material if required but cannot be held responsible for any loss or damage, including any change in the size or quality of images that may result from editing into the site format.

4. While every effort will be made to the contrary we do not guarantee that operation of the site will be uninterrupted or without error and in no event shall the site be liable to any advertiser for any special, consequential, incidental or damages, including loss of profits by such interruptions or errors.

5. The site shall be entitled to reproduce part or all of any image or copy supplied by an advertiser and by submitting an advertisement the advertiser acknowledges the site claims copyright over any material supplied. The site cannot be held responsible for any infringement of copyright laws resulting from material supplied by advertisers and the advertiser indemnifies the site against any action brought for breach of copyright or other rights from the use of such material.

6. It is the advertiser's responsibility to obtain permission for all material submitted to the site as part of advertisements and submission implies that the advertiser is owner of the copyright or is authorised by the owner thereof to grant permission to the site the rights therein contained.

7. The site reserves the right to refuse any hypertext links to, or addresses of, other web sites from advertisements without notice and at our sole discretion and to charge for such links at any time.

8. Advertisements may be amended by the advertiser using the contact us section of the site and all amendments are subject to the same terms detailed herein. Advertisements apply solely to the advertiser that initially posted the advertisement and may not be substituted for another.

9. The site will endeavour to approve new advertisements, changes to existing advertisements as quickly as possibly. However, as the site has no control over the number of requests that we receive at any time, we are unable to guarantee response times.

10. Only one business or property may advertise in each advertisement. The site reserves the right to amend, remove or refuse any advertisement copy or images that do not adhere to this policy.

11. Advertisers may have advertisements removed from the site prior to the end of the agreed term by informing the site in writing through the contact us page although no refunds will be made in any event.

12. The site reserves the right to refuse any advertisement for any reason and will not be liable for any loss or expense in doing so.

13. If an advertiser is found to be contravening the terms and conditions as interpreted by the site we reserve the right to remove their advertisement without refund.

14. The site reserves the right to remove or edit any advertisements that have received complaints that we consider justified against either the advertisement or the advertiser without notice.

15. Payment for advertising on the site is made via the Pay Pal system in Euros by credit or debit card and all rates are fully inclusive of IVA which we are legally required to charge at the rate of 16%. Invoices from the site will be sent to all advertisers after payment has been received and advertisements have been posted.

16. Restaurant reviews

Any entries made in the restaurant reviews area of the site must be genuine and are subject to the same terms and conditions as that of an advertiser. The email address of the user submitting the review must be supplied.

17. Classified advertising

The sites free classified advertising section is subject to the same terms and conditions as advertisers paying to use the site.

18. Property pages and property advertising

i. Advertising in the Property for sale directory is limited to private sales only and any advertisement breaching this condition will be removed with immediate effect and without notice.

ii. Advertisements may only be placed by the legal owner of the property and are placed with the strict understanding that he/she has the necessary power and capacity to authorize sale and that all information provided by the owner within the advertisement or subsequently to a third party is truthful.

iii. The site does not act as an agent and has no responsibility or obligation to sell and offers no guarantees of sale.

iv. The owner and any potential buyer shall indemnify the site and forever discharge the site and its affiliates, partners, service providers, vendors and contractors and each of their respective agents, directors, employees and all other related persons or entities from any and all manner of rights, claims, complaints, demands, proceedings, liabilities, obligations, legal fees, costs or disbursements of any nature, whether known or unknown, which arise now or in the future or have arisen in the past, relate to or are connected with the sale or purchase.

v. Copy within the property pages does not constitute advice and the only advice the site gives is to seek a professional legal representative at the earliest opportunity. vi. Free property advertising is subject to a maximum period of three months and is allowed only once per property.

vii. Premium advertising (charged) is valid until the property is sold however the site accepts no responsibility for sale and at no time will monies paid for advertising be refunded should a sale not be forthcoming.
